Registered Users
We are under no obligation to accept any individual as a registered user and we may accept or reject any application for registration at our sole and complete discretion.
From time to time, we may restrict access to some parts of the Site, or the entire Site, to registered users eg. for scheduled maintenance, unpaid fees or a breach of the terms as set out in these Terms of Use.
Upon becoming a registered user, you will be provided with access credentials such as a Username and Password (and you may be provided with any other piece of information as part of our security procedures). This information is confidential, and you must not disclose it to any third party. Sharing your access credentials with others (especially if they are using your credentials to access our proprietary Content (as defined below)) is a material breach of these Terms of Use. You will promptly inform us of any need to deactivate a Username or Password or change any Unique Identifier.
We have the right to disable any user access credentials, whether chosen by you or allocated by us, at any time and for any reason eg. unpaid fees or a breach of the terms as set out in these Terms of Use and shall have no liability to you for any loss or damage caused by such action.

The products and/or services offered are subject to our acceptance of your order or requests. No order is deemed accepted by us until payment has been received.
We may at any time change or discontinue any aspect or feature of the Site or product and/or service, subject to fulfilling our previous responsibilities to you as purchased.
Prohibited Uses

- Allowing users to comment on a blog post and submit articles to the Site.
Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).

Force Majeure
We shall be under no liability to you in respect of anything that, if not for this provision, would or might constitute a breach of these terms, where this arises out of circumstances beyond our control, including but not limited to: acts of god; natural disasters; sabotage; accident; riot; shortage of supplies, equipment, and materials; strikes and lockouts; civil unrest; computer hacking; or malicious damage.
Suspension and Termination
We will determine, at our discretion, whether there has been a breach of these terms through your use of the Site. When a breach of the terms has occurred, we may take such action as we deem appropriate.
Failure to comply with approved use as defined herein constitutes a material breach, and may result in our taking all or any of the following actions:
- Immediate, temporary or permanent withdrawal of your right to use the Site.
- Immediate, temporary or permanent removal of any posting or material uploaded by you to the site.
- Issue of a warning to you.
- Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
- Further legal action against you.
- Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
To the extent permitted at law, we exclude all liability for our actions taken in response to breaches of the Terms of Use. The responses described above are not limited, and we may take any other action we reasonably deem appropriate.
Jurisdiction and Applicable Law
The Australian courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Site.
These Terms of Use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of the State of Victoria, Australia.
The parties agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to this Agreement by mediation, which shall be conducted under the then current mediation procedures of the Victorian Small Business Commissioner or any other procedure upon which the parties may agree. The parties further agree that their respective good faith participation in mediation is a condition precedent to pursuing any other available legal or equitable remedy, including litigation, arbitration, or other dispute resolution procedures.
The parties understand and agree that, by entering into these terms, we are each waiving the right to a trial by jury or to participate in a class action.
If there is a dispute between users of the Site and/or products purchased or between users and any third party, you understand and agree that we are under no obligation to become involved. In the event that you have any such dispute between users and any third party, you hereby release us, our directors, officers, employees, service providers, affiliates, agents and successors from all claims, demands, and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes.
Recovery of Litigation Expenses
If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable lawyer’s fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

Severability
If any term, provision, covenant, or condition of these Terms of Use is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Terms of Use shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.
Assignment
These Terms of Use bind and inure to the benefit of the parties’ successors and assigns. These Terms of Use are not assignable, delegable, sublicensable, or otherwise transferable by you. Any transfer, assignment, delegation, or sublicense by you is invalid.
Variations
We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on the Site.
